Herts Pasta Terms and Conditions of Business
By placing an order on the Herts Pasta Website and or by email or phone you are agreeing to the following terms and conditions:
Order Acceptance and Cancellation
All orders received are subject to acceptance by Herts Pasta. Herts Pasta reserves the right, at our absolute discretion, to reject any order without giving reasons. In the event of rejection, we will refund or cancel any payments received in full, via the payment method used to place the order.
Timing of Order and Delivery
An order received today before 6.0 pm, can be delivered tomorrow after 1.0 pm and before 7.0 pm under normal conditions and service levels. You will be able to select the delivery date for your order on the web site at the time of check-out. We will make all reasonable efforts to meet your delivery request. Herts Pasta is fresh food. We deliver in boxes that will post through most standard letterboxes. If you are not able to accept delivery at the designated address you will need to nominate a location for us to leave your order.
Changes to Your Order
If you wish to change your order once it has been placed, we will do our best to accommodate that, but we make Herts Pasta fresh to order and may not be able to accommodate all changes. Contact us at firstname.lastname@example.org for change requests.
To cancel an order, please let us know not less than 24 hours before the scheduled delivery time. Contact us at email@example.com
We accept Visa and MasterCard credit and debit cards. In order to offer the best security, all our payments are processed securely by Stripe. Your credit or debit card will be billed upfront on checkout.
If you create an account and enter your payment details, your card will be stored securely by Stripe so that you can check out on future visits without re-entering your card details. We never store or have access to your credit or debit card details.
Prices are stated inclusive of any applicable VAT. All applicable delivery charges are set out explicitly in your order. Orders with a value over £13.00 are delivered free of charge in Berkhamsted and surrounding towns and villages.
We endeavour to maintain stable pricing for our products and prices will always be clear on the website. Prices of food ingredients can vary considerably in the short terms as we source the best quality ingredients. Our sales prices will need to vary over time to reflect the input prices to Herts Pasta.
We are unable to accept returns for practical and health reasons. We offer our customers refunds or replacement delivery if our meals are not delivered to an acceptable quality, as detailed above.
We deliver in our local area using our own staff. We may deliver by reputable carriers, including Royal Mail to other postcodes, using tracked couriers. Applicable delivery charges will be set out clearly before you finalise and purchase the order. We reserve the right, at our absolute discretion, to use any delivery method without prior notification.
We do not ship orders on a Sunday, that may affect the timing of delivery of orders placed on Saturday or Sunday. Timed deliveries are not available.
For deliveries to apartments, you will need to ensure access to the block and your front door or to the nominated safe location to deliver fresh food.
We will always try our best to ensure punctual delivery, however Herts Pasta cannot be held responsible if a delivery arrives late due to any circumstances impacting the availability of the courier and delivery services that we use or anything else outside of Herts Pasta control.
In the event of a failure to deliver to you please contact us at firstname.lastname@example.org as soon as possible. You must contact us within 24 hours of the due delivery.
All of our deliveries of fresh pasta arrive chilled. You must follow the instructions for storage and cooking to receive the best taste experience. These instructions are shown on our website and also on the labels with the food.
Damage and Freshness
Our food products are packed to stay fresh for the extent of delivery and to arrive in good condition. In the event that products arrive damaged due to transit, or appear not to be fresh for reasons beyond our control and not acceptable to you as a result then advise us within 24 hours of the due delivery date to be eligible for a refund. Please include a picture of the damage and details of any concerns about freshness. Should we make a refund there may be a delay of some days in the money being credited back to your purchase card due to normal financial process protocols.
Comments and Feedback
We welcome comments and feedback regarding your Herts Pasta experience. We will do all we reasonably can to make sure our meals and food products are delivered to schedule in good condition. Mistakes do sometimes occur, please advise us of any problems or failed deliveries promptly if we are to react and understand the reasons for our shortfall. Fresh ingredients and in particular seasonal ingredients may have varied and limited supply. Our menu will normally indicate that a particular meal or product is out of stock, but in the event of a late shortage we may need to substitute alternative ingredients at our discretion. We will endeavour to contact you to discuss this, but may not always be able to do so to meet a delivery schedule
Beyond our Control - Adverse Weather and other Events
During adverse weather our delivery partners and our own staff may not be able to deliver orders on time. This is outside of our control and we cannot accept responsibility for the late delivery of the order. We will make refunds for any orders we are unable to fulfill due to adverse weather or other unforeseen events.
Herts Pasta shall not be liable for delay in performing or for failure to perform its obligations if the delay or failure results from any of the following: (i) Acts of God, (ii) outbreak of hostilities, riot, civil disturbance, acts of terrorism, (iii) the act of any government or authority (including refusal or revocation of any licence or consent), (iv) fire, explosion, flood, fog or adverse weather, (v) power failure, failure of telecommunications lines, failure or breakdown of plant, machinery or vehicles, (vi) default of suppliers, sub-contractors or delivery partners, (vii) theft, malicious damage, strike, lock-out or industrial action of any kind, and (viii) any cause or circumstance whatsoever beyond Herts Pasta’s reasonable control.
Herts Pasta Liability
We agree to use all reasonable endeavours to ensure that the products are as described and that our service obligations are met. We cannot however guarantee this and, therefore, accept no responsibility for any interruption of the Herts Pasta service or failings in our products and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control. Except in cases of death or personal injury arising from our negligence, or fraud or fraudulent misrepresentation, our liability in connection with your order with us shall not exceed the price paid to us for the order in question.
Subject to the exclusion above we exclude all liability for any claims, losses, demands and damages, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with our provision of products and services or of your use or inability to access the Herts Pasta products and services, whether arising in contract, tort (including negligence), under statute or otherwise PROVIDED THAT nothing contained in these Terms and Conditions affects or will affect your or the recipient's statutory rights in relation to the quality, fitness or description of the products supplied.
Customer's email address: We use this information to provide a better customer experience by sending order confirmations, substitution information, dispatch confirmations and delivery confirmations. We will also use the customer's email for marketing communications from time to time. Please ensure that email addresses are accurate. If there is an error with your email address or you do not receive an order confirmation within 2 hours please contact us immediately at firstname.lastname@example.org Failure to do so will result in the lapse of any rights to a refund.
Customer's telephone number: We use this information to contact customers in the event of problems with the order such as payment failures or delivery issues.
Recipient's full name and address: We require this information in order to deliver the meals you have ordered. It is vital that the recipient's address is accurate. We will also use the recipient's name and address for marketing communications from time to time.
Other Important Terms
We reserve the right to supplement and amend these Terms and Conditions from time to time without notice. Changes will not affect any order that is already placed, paid for and accepted prior to any changes. New orders will be accepted under the revised Terms.
These Terms and Conditions will be deemed to include all Notices, Descriptions and Disclaimers placed on the Herts Pasta website or delivered in printed form or by email from time to time.
A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.
In respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.
These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts. No variation to these Terms may be made by any party unless agreed in writing or email by a Principal of Herts Pasta. No oral variation to the Terms can be made on any basis.
